On December 27, 2024, a decree was published amending the Fiscal Code of Mexico City, introducing a new obligation for owners of residential properties whose value is equal to or greater than MXN $4,524,974.08. The obligation requires the submission of an annual statement before the Secretary of Administration and Finance of Mexico City (SAF) on the occupancy status of their properties.
Such statement aims to provide the SAF with updated information on the use and occupancy of residential properties in Mexico City. This information will be used for informational and statistical purposes to improve the management and planning of public policies related to the real estate sector in Mexico City.
This statement must be filed before the SAF no later than June 30 of each year.
The Treasury of Mexico City will enable the electronic means for the submission of the declaration no later than the month of March of each year.
The official form that taxpayers must fill out for the declaration will include, among other data, the following:
• Taxpayer and property tax account information.
• Occupancy status of the property.
• Current use of the property.
• Consent will be requested to share the information provided for statistical purposes. If you do not authorize, the taxpayer must explain the reason for their refusal.
